Welcome to HORDE STUDIO

HORDE STUDIO provides website features and other products and services to you when you visit or shop at HORDE STUDIO (the “website”), use HORDE STUDIO devices, products, or services, use HORDE STUDIO applications for mobile, or use software provided by HORDE STUDIO in connection with any of the foregoing (collectively “HORDE STUDIO Services”). Please see our  Privacy Notice to understand how we collect and process your personal information through HORDE STUDIO Services. HORDE STUDIO provides the HORDE STUDIO Services and sells our products to you subject to the conditions set out on this page. 

Conditions of Use

Please read these conditions carefully before using HORDE STUDIO. By using HORDE STUDIO, you signify your agreement to be bound by these conditions. We offer a wide range of HORDE STUDIO Services, and sometimes additional terms may apply. When you use an HORDE STUDIO service (for example Your Profile, Gift Cards or HORDE STUDIO applications for mobile), you will also be subject to the terms, guidelines and conditions applicable to that HORDE STUDIO Service (“Service Terms”). If these Conditions of Use are inconsistent with the Service Terms, those Service Terms will control.

  1. ELECTRONIC COMMUNICATIONS

When you use any HORDE STUDIO Service or send e-mails to us, you are communicating with us electronically. We will communicate with you electronically in a variety of ways, such as by e-mail, text, in-app push notices or by posting e-mail messages or communications on the website or through the other HORDE STUDIO Services. For contractual purposes, you agree that all agreements, notices, disclosures and other communications that we provide you electronically satisfy any legal requirement that such communications be in writing, unless mandatory applicable laws specifically require a different form of communication.

  1. RECOMMENDATIONS AND PERSONALISATION

As part of the HORDE STUDIO Services, we will recommend features, products, and services, including third part ads that might be of interest to you, identify your preferences, and personalise your experience.

3. COPYRIGHT, AUTHORS’ RIGHTS AND DATABASE RIGHTS

All content included in or made available through any HORDE STUDIO Service, such as text, graphics, logos, button icons, images, audio clips, digital downloads and data compilations is the property of HORDE STUDIO or its content suppliers and is protected by international copyright, authors’ rights and database right laws. The compilation of all content included in or made available through any HORDE STUDIO Service is the exclusive property of HORDE STUDIO and is protected by international copyright and database right laws.

You may not extract and/or re-utilise parts of the content of any HORDE STUDIO Service without our express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation any substantial parts of the content of any HORDE STUDIO Service, without our express written consent. You may also not create and/or publish your own database that features substantial parts of any HORDE STUDIO Service (e.g. our prices and product listings) without our express written consent.

4. TRADEMARKS

HORDE STUDIO trademarks and trade dress may not be used in connection with any product or service that is not HORDE STUDIO, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits HORDE STUDIO. All other trademarks not owned by HORDE STUDIO that appear in any HORDE STUDIO Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by HORDE STUDIO.


HORDE STUDIO’ trademarks include but are not limited to the HORDE STUDIO name and logo. Please note that your use of this Website does not grant you any rights to use our trademarks.

All products sold on the Horde Studio website are products sold under the HORDE STUDIO brand and as such benefit from the intellectual and commercial protection of this brand which is registered.

5. PATENTS

One or more patents owned by HORDE STUDIO apply to the HORDE STUDIO Services and to the features and services accessible via the HORDE STUDIO Services. Portions of the HORDE STUDIO Services operate under license of one or more patents.

6. LICENCE AND ACCESS

Subject to your compliance with these Conditions of Use and applicable Service Terms and your payment of any applicable fees, HORDE STUDIO or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and make personal and non-commercial use of the HORDE STUDIO Services. This licence does not include any resale or commercial use of any HORDE STUDIO Service or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any HORDE STUDIO Service or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted to you in these Conditions of Use or any Service Terms are reserved and retained by HORDE STUDIO or its licensors, suppliers, publishers, rights holders, or other content providers. No HORDE STUDIO Service, nor any part of any HORDE STUDIO Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not frame or use framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout, or form) of HORDE STUDIO without our express written consent. You may not use any meta tags or any other “hidden text” utilising HORDE STUDIO names or trademarks without our express written consent.

You may not misuse the HORDE STUDIO Services. You may use the HORDE STUDIO Services only as permitted by law. The licences granted by HORDE STUDIO terminate if you do not comply with these Conditions of Use or any Service Terms.

7. YOUR ACCOUNT

You may need your own HORDE STUDIO account to use certain HORDE STUDIO Services, and you may be required to be logged into the account and have a valid payment method associated with it.

If there is a problem charging your selected payment method we may charge any other valid payment method associated with your account. 

If you use any HORDE STUDIO Service you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and to the extent permitted by applicable law you agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorised manner. You are responsible for ensuring that the details you provide us with are correct and complete, and for informing us of any changes to the information you have provided. You must not use any HORDE STUDIO Service: (i) in any way that causes, or is likely to cause, any HORDE STUDIO Service, or any access to it to be interrupted, damaged or impaired in any way, or (ii) for fraudulent purposes, or in connection with a criminal offence or other unlawful activity, or (iii) to cause annoyance, inconvenience or anxiety.

We reserve the right to refuse any HORDE STUDIO Services or terminate accounts if your behaviour gives justified reason to do so. This will in particular be the case if you are in breach of applicable laws, applicable contractual provisions, our guidelines or our policies, which are all accessible on the website. Notwithstanding any such limitation or termination, you will continue to have access to content and services purchased by you up to that point.

8. REVIEWS, COMMENTS, COMMUNICATIONS AND OTHER CONTENT

Visitors may post reviews, comments and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of “spam”. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. We reserve the right to remove or edit such content. If you believe that any content on or advertised for sale on any HORDE STUDIO Service contains a defamatory statement, or that your intellectual property rights are being infringed by an item or information on any HORDE STUDIO Service, please notify us by completing and we will respond.

If you post customer reviews, comments, customer questions or answers, or other content generated by you for display on the website (including any images, video or audio, all together “content”, you grant HORDE STUDIO (a) a non-exclusive, royalty-free licence to use, reproduce, publish, make available, translate and modify such content throughout the world (including the right to sublicense these rights to third parties) and (b) the right to use the name that you submit in connection with such content. No moral rights are transferred by this provision.

You may delete your content from public view or, where such functionality is offered, change settings so that it is only shown to people to whom you grant access.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is posted: (i) the content and material is accurate; and (ii) use of the content and material you supply does not breach any applicable policies or guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify HORDE STUDIO for all claims brought by a third party against HORDE STUDIO arising out of or in connection with the content and material you supply except to the extent that any liability arises from our failure to properly remove the content when it is notified of the illegal nature of the content  arising out of or on the grounds of, or originating from the content that you have communicated to us. By deleting content from public view, you withdraw your license for HORDE STUDIO to publish and make available that content publicly.

9. OUR LIABILITY

We will do our utmost to ensure that availability of the HORDE STUDIO Services will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Also, your access to HORDE STUDIO Services may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

HORDE STUDIO will not be responsible for (i) losses that were not caused by any breach on our part, or (ii) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure), or (iii) any indirect or consequential losses that were not foreseeable to both you and us when you commenced using the HORDE STUDIO Services.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your legal right to have goods sent or services provided within a reasonable time or to receive a refund if goods or services ordered cannot be supplied within a reasonable time owing to a cause beyond our reasonable control.

The laws of some countries do not allow some or all of the limitations described above. If these laws apply to you, some or all of the above limitations may not apply to you and you might have additional rights.

Nothing in these conditions limits or excludes our responsibility for fraudulent representations made by us or for death or personal injury caused by our negligence or wilful misconduct.

10. APPLICABLE LAW

These conditions are governed by and construed in accordance with the laws of law of England and Wales, and the application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. If you are a consumer and have your habitual residence in the EU, you additionally enjoy the protection afforded to you by mandatory provisions of the law of your country of residence. We both agree to submit to the non-exclusive jurisdiction of the courts of the district of Cardif, which means that you may bring a claim to enforce your consumer protection rights in connection with these Conditions of Use in UK or in the EU country in which you live. If you reside in the EU, the European Commission provides for an online dispute resolution platform, which you can access here: https://ec.europa.eu/consumers/odr. If you would like to bring a matter to our attention, please contact us.

11. EXPORT CONTROLS

You agree that you will not export, re-export, or transfer any products  that you have purchased on the website to any country, individual, corporation, organisation, or entity to which such export is restricted or prohibited by law. For example, economic sanctions and embargoes imposed by the European Union, the United Nations, US Departments of State, Treasury or Commerce, and other government authorities (such as embargoes imposed on specific countries, or economic sanctions imposed on individuals or companies for terrorism or money laundering offences) may prohibit you from taking products to other countries, even for your own personal use, and/or sending products (whether physically by mail or digitally via email or file-sharing) to particular individuals, corporations, organisations or entities. In addition, you agree that you will not purchase any product or service from the website if you are subject to restrictive measures (sanctions).”

12. ALTERATIONS TO SERVICE OR AMENDMENTS TO THE CONDITIONS OF USE

We reserve the right to make changes to any HORDE STUDIO Services, policies, terms and conditions including these Conditions of Use, and Service Terms at any time. You will be subject to the terms and conditions, policies and Conditions of Use in force at the time that you use the HORDE STUDIO Services. If any of these Conditions of Use is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

13. WAIVER

If you breach these Conditions of Use and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Conditions of Use.

14. CHILDREN

We do not sell products for purchase by children. We sell children’s products for purchase by adults. If you are under 18 you may use the HORDE STUDIO Services only with the involvement of a parent or guardian.

Conditions of Sale

These Conditions of Sale govern the sale of products by HORDE STUDIO to you. When you use an HORDE STUDIO Service (for example Your Profile, Gift Cards or HORDE STUDIO applications for mobile), you will also be subject to the terms, guidelines and conditions applicable to that HORDE STUDIO Service (“Service Terms”). If these Conditions of Sale are inconsistent with the Service Terms, those Service Terms will control.

Please read these conditions carefully before placing an order with HORDE STUDIO. By placing an order with HORDE STUDIO , you signify your agreement to be bound by these conditions.

  1. PLACING ORDER

By using the Website and/or placing an order on the Website, by telephone, e-mail or by live chat you confirm that you have read these Terms and Conditions and the Privacy Policy, and that you accept them. Please make sure that you have read and understood the Terms and Conditions before you place an order. An order can only be placed if you have previously confirmed that you accept these Terms and Conditions. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that products in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the Website to fail, your selection of products may be lost. In such case, you will be required to re-enter your selection of products to the shopping bag.

  1. ORDER CONFIRMATION

After submitting your order, we will send you an order confirmation e-mail with your order number, details of the product you have ordered from us, your payment details and delivery details. Please note that the confirmation e-mail is an acknowledgement that we have received your order and is not an acceptance of the order.

  1. ACCEPTANCE AND SHIPPING CONFIRMATION

Please note that all orders placed by you are subject to acceptance by us. We may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you. Once the order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order and these Terms and Conditions. The shipping confirmation is our acceptance of your order. Please note that HORDE STUDIO does not guarantee that all products presented on the Website are in stock at the time of your order. If a product is unavailable, we will contact you shortly, by phone or by e-mail. If we already have received payment for such product we will refund you the amount of the purchase.

  1. COLORS

HORDE STUDIO’ goal is to describe the products at the Website as correctly as possible. However, please note that due to the color settings of your computer, the colors of the products shown in the pictures on the Website can differ somewhat from their actual colors. HORDE STUDIO cannot be held responsible for any such discrepancy.

  1. PRICES

The prices and delivery costs shown on the Website include VAT. The prices and delivery costs shown on the Website may vary from time to time and HORDE STUDIO is not bound by the price until HORDE STUDIO has accepted the order by sending the shipping confirmation to you. The prices may also vary between the physical store and the Website. If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by e-mail about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be cancelled. HORDE STUDIO always reserves the right to cancel any order prior to our acceptance of the order. If we already have received payment for a cancelled order we will refund you the amount of the purchase. The refund is made using the same payment method you used at the purchase. Please also note that HORDE STUDIO may cancel the order even if it has been accepted by HORDE STUDIO under the condition that you realize or should have realized that the price information was incorrect. The delivery costs are shown in connection with the shipping methods at the checkout stage.

When ordering products from HORDE STUDIO for delivery outside of mainland UK you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from HORDE STUDIO, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the products. Your privacy is important to us and we would like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

  1. PERSONALISED ITEMS

Personalised products through printing of initials cannot be returned or refunded. Once the order has been sent by the customer and confirmed by HORDE STUDIO, the customer will be informed via an order confirmation email. Once the order is processed and accepted, the customer will receive a shipping confirmation email. Personalised items may be delivered in a time slot indicated on the site which may be longer than regular delivery slots. Because of the clearly personalized nature of personalised products and the fact that they are produced specifically for the customer, they cannot be returned, refunded or exchanged. Similar, the customer does not have the right to cancel the order.

  1. PAYMENTS

The following payments are accepted.

Credit cards

Payment can be made by the following credit cards: Visa, Mastercard, Diners Club and American Express. The purchases made with Visa and Mastercard are verified by a secure code. Please note that your card is debited with the purchase amount once you place the order. We do our best to make the Website as secure as possible. All credit card transactions on the Website are processed using Adyen, a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account once you place the order. You confirm that the credit card that is being used is yours or that you have been specifically authorized by the owner of the credit card to use it. All credit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to HORDE STUDIO, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order.

Paypal

When selecting the PayPal option, you will be directed to the PayPal site to “Log In” and review the amount shown before clicking “Pay Now”. Once this transaction is complete, you will then return to the Website.

Stored Credit Cards

At Checkout you can chose to save your credit card for future purchases if you are logged in to your HORDE STUDIO account. Your details will be protected using Global Sign Encryption and will speed up your checkout the next time you shop.

Gift Cards

When placing an order using a gift card as payment, the order can only be shipped to the same country as to where the gift card was issued. HORDE STUDIO are unable to change the currency of the gift card, and it is always country specific. Gift cards purchased online cannot be used in store, and gift cards purchased in store cannot be used online. Gift cards are valid one year from the date when they were purchased.

  1. DELIVERY

Shipping methods

We offer different shipping methods to meet your needs as further specified when you check out.Dispatch of orders may take up to 7 business days but we aim to dispatch all orders within 24 hours during weekdays, or 1-2 business days during sales periods. The delivery times do not take into account possible delays caused by payment authorization and/or on the part of the shipping company. If HORDE STUDIO fails to deliver within 30 days, you have the right to cancel the purchase.
Your order will be delivered by UPS to the shipping address you have indicated.
All orders are fully traceable on the Website by logging in to My account. Click “My Orders” and fill in the tracking number for updated information about your shipment.

First-time order policy

For security purposes, HORDE STUDIO reserves the right to ship first-time orders to the cardholder’s verified billing address or work address. To avoid delays in receiving your order, please make sure to provide the correct billing and shipping information associated with your credit/debit card when placing an order.

  1. INFORMATION OF THE RIGHT OF REVOCATION

Right of Revocation

You are entitled to revoke this contract within 14 days without giving reasons. The revocation period is 14 days from the day on which you have, or a third person designated by you (other than the carrier) has, received the products. In order to exercise your right of revocation, you must inform us at XXXXXXXXXXXXXXXX by means of an unambiguous notification (e.g. through letter sent by post, fax or e-mail) of your decision to revoke this contract. You may electronically complete and submit the specimen revocation form provided on our website. This is, however, not compulsory. In oder to comply with the time limit for revocation, it is sufficient that you send the notification of the exercise of the right of revocation before the time limit for revocation expires.

Consequences of revocation

If you revoke this contract, we are obliged to return to you, promptly but in no case later than within 14 days from the day on which we have received the notification of your revocation, all payments that we have received from you including the costs of delivery (except any additional costs that result from you having chosen a different method of delivery than the cheaper method offered by us). For such repayment, we will use the same means of payment that you have used for the initial transaction unless expressly agreed with you otherwise; in no case will we charge you any fees due to such repayment. We are entited to refuse repayment until we have recovered the products or you have evidenced that you have sent the products back to us, whichever occurs first. Your are obliged to send back or hand over the products to us promptly, but in no case later than within 14 days from the day on which you notified us of the revocation of this contract. The time limit is complied with if you send the products before the expiration of the 14 days’ time limit. You have to bear the direct costs of the reconsignment of the products. Any potential loss in value of the products will have to be compensated by you only if such loss in value is attributable to your handling of the products which is not necessary for the verification of their condition, quality or functionality.

Exchanges

Purchased products are exchangeable into a different size and color in accordance with the terms set forth in this section 11. All exchanges are based on stock availability. If you have exchanged a product, HORDE STUDIO will pay the shipping costs for the new product. Please note that sale products are non-exchangeable but can be returned for a full refund.

Shipping costs for reconsigning the products

Please note that you must pay the shipping cost for returning the products in accordance with your right of withdrawal and exchange and HORDE STUDIO has no obligation to pay such costs.

Returning the products

When a customer order is send out we include a despatch note with the order, at the bottom of the despatch note is a return slip that the customer can cut off and send with their return.

It is important for us to have the return slip as it has the MMS Order ID number indicated on it so as that we can process the return.

Please make sure to fill out the returns slip provided which is located at the bottom of the dispatch note.

Once the return has reached us, we will process the return within 2-3 working days.

We will check the item to see whether it can be resold and if the return or refund can be done.

You can easily and conveniently handle the reconsignment of your purchased products as follows:

  • Visit xxxxxxxxxx. and log into your account to begin a return or exchange.
  • You can view your orders and must request a return or exchange item for any unwanted items.
  • Place the item(s) in the original shipping box, or any other solid carton box.
  • Close the box and tape it securely.
  • Place the return information label and the already paid return shipping label on the box over the prior delivery information.
  • Visit www.ups.com and click “Contact ups” and the bottom left of the screen.
  • Call UPS customer service to arrange a collection.

We prefer that products are returned through HORDE STUDIO return service to ensure they are protected and insured during transit. However, you may return the products by any secure transport.

  1. DEFECTIVE PRODUCTS

If you receive defective products, please notify us immediately. According to the Civil Act you are entitled to complain about defective products within one year. However, you must always notify HORDE STUDIO within a reasonable time after you have detected that the products are defective. If HORDE STUDIO consider the products to be defective, HORDE STUDIO will make a full refund including shipping costs.

  1. COOKIES

Cookies are used on the site to improve your browsing experience. In addition to use for statistical purposes, cookies identifies your computer and allows the site to recall your personal settings. You browser can be set to send a notification when a cookie is activated. This allows you to deny use of this cookie or to delete the cookie at the end of your visit. The Website cannot be accessed if cookies are disabled. By browsing the Website you consent to the use of cookies.

  1. SECURITY

HORDE STUDIO use Secure Socket Layers (SSL), the industry standard in transferring information to process your orders. HORDE STUDIO online shop secures communications by encrypting all data to and from the site. When placing an order, you can immediately check the security validity by clicking the Thawte icon at checkout. For security reasons, we do not store any payment information in our database.

  1. INFORMATION ON THE WEBSITE

HORDE STUDIO cannot promise that the content of the site is free of inaccuracies or typographical errors. Neither can we guarantee that all information is up-to-date. HORDE STUDIO may, at any time, amend the content of the site. Although HORDE STUDIO strives to display the correct texts, images and pricing on the site and online shop, errors may occur. Part of the services provided through the site are maintained by third party operators. In situations where HORDE STUDIO acts as agent for such services, we cannot be held responsible for any errors resulting from their activities. HORDE STUDIO cannot be held responsible for any damage caused from using the site or, for that matter, not being able to use the site. HORDE STUDIO cannot guarantee problem-free, uninterrupted, and secure access to the site.

  1. LINKS

The Website may contain links to other websites beyond our reach. We cannot be held liable for content or privacy policies of such sites.

  1. VIOLATION OF RULES

HORDE STUDIO reserves the right to seek all solutions available to us against violations of these Terms and Conditions, including the right to block access to the site.

  1. LIABILITY

Any damage liability of HORDE STUDIO is excluded. Exempted from this exclusion are claims of the customer related to damages to health, body and mind, or damages resulting from a violation of material contractual obligations (cardinal duties), as well as the liability for other damages which are based on intent or gross negligence of HORDE STUDIO, its representatives and vicarious agents. Material contractual obligations are obligations which are precondition to the successful performance of the contract and on the observation of which the customer can legitimately rely. In the event of a violation of material contractual obligations, HORDE STUDIO’ liability is limited to the foreseeable and typical damage if such damage has been caused slightly negligent, unless a damage to health, body and mind is concerned. The limitations set forth above also apply for the benefit of the representatives and vicarious agents of HORDE STUDIO if claims are made directly against them. The liability under the Product Liability Act remains unaffected. HORDE STUDIO assumes no liability in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. In case of force majeure, HORDE STUDIO’ obligations will be suspended. The contract between you and HORDE STUDIO can, in such cases, be partially or fully terminated by yourself or by HORDE STUDIO.

  1. PROVISIONS SEVERABILITY

If any part of these Terms and Conditions are held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms and Conditions; instead the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these Terms and Conditions.

THESE TERMS AND CONDITIONS ARE GOVERNED BY THE LAWS OF UNITED KINGDOM (EXCLUDING THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS – CISG). THE PLACE OF JURISDICTION FOR ANY DISPUTES ARISING FROM OR PERTAINING TO THESE TERMS AND CONDITIONS IS LONDON.
